Can GST registration be cancelled without a tax officer now?

A2Z Taxcorp and SAG Infotech both report CBIC Notification No. 05/2026-Central Tax dated 26 October 2026. It substitutes Rule 20 of the CGST Rules, 2017 with effect from 1 November 2026.

If the conditions are met, the GST portal cancels the registration electronically from the date you asked for. The cancellation is communicated in the new Form GST REG-38.

What must you do before you apply for GST cancellation?

Both reports say you must apply in Form GST REG-16 within 30 days of the event that makes cancellation necessary. The 30 day limit does not apply on the death of a sole proprietor.

You must file all returns due up to the cancellation date, including Form CMP-08 where it applies. If you filed GSTR-1 or the IFF for a month, the GSTR-3B for that month must also be filed.

The form asks for details of stock in hand and the tax on it.

When is cancellation automatic?

Both reports say returns must be filed on time and tax, interest, fees and penalties paid. Then one of two things must be true.

One, your output tax liability reported in GSTR-1 or the IFF on supplies to registered persons did not exceed ₹2.5 lakh in any month since you registered. Two, you filed the final return in Form GSTR-10 within three days of the due date of the remaining returns.

What happens if you do not meet these conditions?

Both reports say the application then goes to the tax officer. The officer has 15 days to cancel the registration in Form REG-19 or to send a notice in Form REG-03, and you have 15 days to reply in Form REG-04.

If the officer does not act within the time, the application is deemed approved. Your registration stays suspended while the application is pending.

What is not yet confirmed?

We could not open the CBIC notification or the GST portal advisory, because the official sites block our tools. One of the reports links the ₹2.5 lakh test to input tax credit passed on, while the other and the rule text it quotes say output tax liability. We use the output tax wording and flag the difference.

Both reports also say Form REG-16 and Rule 44 change again on 1 December 2026. Read the notification before you apply.
