FSSAI declaration and nominee letter (Form IX sample)
A sample declaration by a food business and a letter naming the person (nominee) who is responsible for food safety rules. Companies, firms and institutions are asked to name a nominee when they apply for an FSSAI licence.
This is a sample, not an official form. Offices and states differ. Check this text with the issuing office before you sign, and use the office's own form if it gives you one. Govt License does not give legal advice.
What it is for
Use it when you apply for an FSSAI licence as a company, partnership firm or other organisation. A person running as a single owner usually does not need a nominee.
Who signs
The proprietor, all partners or authorised directors sign the declaration. The nominee signs the acceptance.

PART 1. NOMINATION
We, the undersigned, nominate ________, son, daughter or wife of ________, working as ________, resident of ________, as the person responsible for making sure that the food business at the above premises follows the Food Safety and Standards Act, 2006 and its rules and regulations.
The nominee is authorised to sign and submit applications and returns on behalf of the business, to receive notices and orders from the Food Safety department, and to deal with the officers of the department.
PART 2. DECLARATION

1. All the information given in the application for an FSSAI licence or registration is true and correct.
2. The business will follow the Food Safety and Standards Act, 2006 and the rules and regulations made under it, including the hygiene and safety standards for the premises.
3. The business will not sell or store any food that is unsafe, adulterated, misbranded or banned.
4. The business will keep the licence or registration number displayed at the premises and on its bills, and will renew or update it as required.
5. We will tell the Food Safety department if the nominee changes.

Common questions
Is this the official FSSAI Form IX?
No. This is a plain sample. FSSAI has its own prescribed forms. If the FoSCoS portal or the Food Safety officer gives you a form to use, use that one. Confirm on foscos.fssai.gov.in.
Who can be the nominee?
Someone who works in the business and can take responsibility for food safety, such as a partner, director or manager. Ask the portal or the officer for the exact rule for your kind of business.
Does a single owner need a nominee?
Usually not, because the owner is the person responsible. Check the licence type you apply for on FoSCoS.
